Terms of Service

These terms govern your access to and use of the Forge platform, APIs, and SDKs. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Forge platform, APIs, or SDKs (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app banner at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Accounts & Access

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If we learn that an account holder is under this age, we will terminate the account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for more than 12 consecutive months.

3. Acceptable Use

You may use the Service for lawful purposes consistent with these Terms. You retain ownership of all data you transmit through the Forge platform, including API payloads, webhook configurations, and uploaded documents.

You agree not to: (a) reverse-engineer, decompile, or attempt to extract source code from the Service; (b) use the Service to transmit malware or conduct denial-of-service attacks; (c) circumvent rate limits, including by rotating API keys; (d) resell or redistribute access to the Service without authorisation; or (e) use automated tools to scrape or bulk-extract data from the Service.

We may establish and enforce usage limits (API calls, storage, webhook deliveries) based on your subscription tier. Exceeding these limits may result in HTTP 429 responses or temporary suspension of access.

4. API Usage & Rate Limits

Your plan determines your API rate limits and included usage. Rate limit headers are included in every API response so you can monitor consumption programmatically.

If you exceed your plan's rate limits, requests will receive HTTP 429 responses with a Retry-After header. Sustained or deliberate abuse of rate limits — including key rotation to circumvent them — constitutes a breach of these Terms.

We reserve the right to throttle or suspend API access if usage patterns suggest abuse, compromise, or risk to the platform's stability.

5. Billing & Payments

Paid plans are billed in advance on a monthly or annual cycle. Prices are listed in USD and exclude applicable taxes, which will be calculated at checkout based on your billing address.

You may cancel your subscription at any time from Settings > Billing. Cancellations take effect at the end of the current billing period — you will not be charged again, and you retain access until then.

Refunds are available within 14 days of purchase if you have made fewer than 1,000 API calls on the plan. After 14 days, or if usage exceeds this threshold, refunds are at our discretion. Enterprise contracts follow the refund terms specified in the individual agreement.

We reserve the right to change pricing with at least 30 days' notice. Price changes apply to the next billing cycle, not retroactively.

6. Intellectual Property

The Forge platform, including its design, code, brand assets, APIs, SDKs, and documentation, is the intellectual property of REPLACE WITH YOUR LEGAL COMPANY NAME. These Terms do not grant you any ownership rights in the Service.

You retain full ownership of the data you transmit through and create using the Service. By using the Service, you grant us a limited licence to process your data solely to deliver the Service to you.

Feedback, suggestions, and feature requests you submit may be used by us without obligation to compensate you, unless otherwise agreed in writing.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

8. General Provisions

These Terms are governed by the laws of REPLACE WITH YOUR JURISDICTION, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of a recognised arbitration body in that jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and REPLACE WITH YOUR LEGAL COMPANY NAME regarding the Service and supersede all prior agreements.
